By accessing or using onyxelle.ca (the "Site") or making a purchase from Onyxelle Canada ("Onyxelle", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree, do not use the Site.
You must be at least 18 years old, or the age of majority in your province, with legal capacity to enter into a binding contract under Canadian law.
You may create an account for faster checkout and order tracking. You are responsible for maintaining password confidentiality. Notify us at contact@onyxelle.ca of any unauthorized use.
Order placement is an offer; we may accept or decline at our discretion. We may cancel orders for: suspected fraud, address verification failure, items out of stock, or pricing errors. Cancelled orders are fully refunded within 5-10 business days. You may cancel before shipment by emailing contact@onyxelle.ca. Once shipped, see our Refund Policy.
Payment is processed via Shopify Payments / Stripe / PayPal. By submitting payment details, you authorize us to charge for the full order total (including taxes). We do not store full credit card numbers.
All Site content — text, images, logos, designs, photography, video, code, layout — is owned by Onyxelle or licensed to us, protected by Canadian and international copyright/trademark law. The "Onyxelle" name and logo are trademarks of Onyxelle Canada. Product names are trademarks of Onyxelle. You may not reproduce, distribute, or use Site content commercially without written permission.
If you submit reviews, photos, or comments ("User Content"), you grant Onyxelle a non-exclusive, worldwide, royalty-free, perpetual license to use, display, modify, and distribute that content for marketing and operations. You confirm you own the rights.
You agree not to: use the Site unlawfully; attempt unauthorized access; use bots/scrapers; reverse-engineer; submit false information; engage in fraudulent transactions. We may suspend accounts that violate these Terms.
Onyxelle pieces are gold-plated jewelry made from a surgical-grade 316L steel core with 18K gold electroplating. Claims like "tarnish-resistant", "hypoallergenic", and "made for everyday" reflect characteristics under normal everyday wear. Plating wear over years of normal use is not a defect. Individual results may vary based on skin chemistry, environmental factors (chlorine pools, harsh chemicals, abrasion), and care.
The Site and products are provided "as is" and "as available". To the maximum extent permitted by law, Onyxelle disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
To the maximum extent permitted by Canadian law, Onyxelle's total aggregate liability is limited to the amount you actually paid for the specific product, in the 12 months prior to the event. Onyxelle is not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or business interruption.
Onyxelle is not liable for delays, failures, or non-performance caused by events outside reasonable control: natural disasters, pandemic, war, postal strikes, customs holds, supplier failure, severe weather, government action, or internet/utility outages.
You agree to indemnify and hold harmless Onyxelle from any claim arising out of: (a) your breach of these Terms, (b) your User Content, (c) your violation of law, or (d) your misuse of the Site.

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario, except where mandatory consumer-protection laws of your province grant exclusive jurisdiction.
If any provision is unenforceable, the remaining provisions remain in full effect.
We may modify these Terms at any time. Continued use after changes = acceptance.
