These Terms govern your access to and use of onyxelle.ca and the purchase of products from us. By accessing the site or placing an order, you agree to these Terms. The site is operated by Cynthia Paradis, doing business as ONYXELLE ("ONYXELLE", "we", "us", "our").

By using onyxelle.ca, you confirm that you are at least 18 years old (or have permission from a legal guardian), provide accurate information, and use the site lawfully.

You may browse without an account. To track orders or save preferences, you can create one. You are responsible for keeping your password confidential and for all activity under your account.

3. Products and Pricing

• Slight variations in color, size, or finish may occur and are not defects.
• Prices are listed in Canadian dollars (CAD) and exclude taxes.
• Sales tax (GST/HST/PST) is calculated at checkout based on your shipping address.
• We reserve the right to change prices, products, and promotions at any time without notice.
• We reserve the right to refuse or cancel any order, including for pricing errors, inventory issues, or suspected fraud.

4. Payment

We accept Visa, Mastercard, American Express, Apple Pay, Shop Pay, Google Pay, and PayPal. Payment is processed at order placement.

5. Order Acceptance

Receiving an order confirmation email does not constitute acceptance of your order. We reserve the right to verify and accept or refuse any order at our discretion.

6. Shipping and Returns

Shipping terms are described in our Shipping Policy. Returns and refunds are governed by our Refund Policy.

7. Promotions and Discount Codes

• Promotional codes have specific terms (validity, exclusions, minimum purchase).
• Codes cannot be combined unless explicitly stated.
• Bundle discounts (e.g., Buy 2, Get 1 Free) apply automatically at checkout.
• We reserve the right to cancel orders using fraudulently obtained codes.

8. Intellectual Property

All content on onyxelle.ca — text, images, logos, design, the "ONYXELLE" name, product photography — is the property of Cynthia Paradis (operating as ONYXELLE) or used under license. You may not copy, modify, distribute, or use any of our content commercially without written permission.

9. User Content

By submitting reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display the content for marketing purposes. You confirm the content is yours, doesn't violate third-party rights, and is truthful.

10. Prohibited Use

• Use the site for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or reverse-engineer the site or its content
• Submit false reviews or impersonate other users
• Use bots or automated tools without permission

11. Disclaimer of Warranties

The site and products are provided "as is" without warranties of any kind, except those required by law. Our jewelry comes with a Lifetime Tarnish Guarantee and a 60-day return window.

12. Limitation of Liability

To the maximum extent permitted by Canadian and Quebec law, ONYXELLE's total liability is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. These limitations do not apply where prohibited by Quebec consumer protection law.

13. Indemnification

You agree to indemnify and hold harmless ONYXELLE, Cynthia Paradis, and our affiliates from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the site.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any dispute will be resolved exclusively by the courts of the District of Trois-Rivières, Quebec.

15. Termination

We may suspend or terminate your access to the site at any time for violation of these Terms or for any other reason at our discretion.

16. Changes to These Terms

We may update these Terms periodically. Continued use of the site means you accept the updated Terms.

17. Severability

If any provision is held invalid, the remaining provisions continue in full force.

18. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and ONYXELLE.
